Welcome to Ki ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Ki web application, services, and related features (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Ki is an empathic AI companion that uses advanced voice technology and emotion detection to provide personalized conversational experiences. Our Service helps users process emotions, gain insights, and receive personalized letters summarizing their conversations. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

Ki provides an AI-powered conversational platform featuring:

  • Emotion detection and analysis through voice tone and speech patterns

  • AI-generated personalized letters summarizing conversation insights
  • Email delivery of conversation summaries and insights
  • Early access features for beta testing new capabilities

2.1 Age Requirements

You must be at least 13 years old to use our Service. If you are under 18, you must have your parent or guardian's permission to use the Service.

2.2 Account and Access

While Ki does not require account creation for basic use, you may provide an email address to receive personalized letters and updates. You are responsible for providing accurate information and maintaining the confidentiality of any credentials associated with your use of the Service.

3. Voice Data and User Content

3.1 Voice Recordings and Transcriptions

When you use Ki's voice features, your voice is processed in real-time to enable conversation and emotion detection. Voice data is transcribed and analyzed to provide personalized responses and generate insights. You retain ownership of your voice data and conversation content ("User Content").

3.2 License to Process Content

You grant us a limited, worldwide, non-exclusive, royalty-free license to process, analyze, and use your User Content for the following purposes:

  • Providing real-time conversational responses
  • Detecting and analyzing emotional patterns
  • Generating personalized letters and insights
  • Improving our AI models and Service quality
  • Delivering requested features like email summaries

3.3 Content Restrictions

You are responsible for your User Content and must not share content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Infringes intellectual property rights or other rights of third parties
  • Contains malicious code, viruses, or harmful software
  • Constitutes spam, advertising, or unsolicited promotional materials

We reserve the right to monitor, review, and remove any User Content that violates these Terms or that we find objectionable, without prior notice. We may also suspend or terminate access to users who repeatedly violate these content guidelines.

4. Privacy and Data Protection

4.1 Voice and Emotion Data

Ki processes voice data in real-time using Hume AI technology to detect emotions and provide personalized responses. This processing helps create more empathetic and contextually appropriate conversations. Voice recordings are not permanently stored beyond what is necessary for service delivery.

4.2 Data Security

We implement industry-standard security measures including encryption, secure data transmission, and access controls. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security. We will notify you of any data breaches that may affect your personal information.

5. Intellectual Property

The Service, including its content, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or otherwise exploit any of the material on our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your Web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution

6. Medical and Professional Disclaimers

6.1 Not Professional Advice

IMPORTANT: Ki is not a substitute for professional medical, psychological, psychiatric, legal, financial, or other professional advice, diagnosis, or treatment. The Service is designed for emotional support and conversation but should never replace professional healthcare or therapy.

6.2 Emergency Situations

If you are experiencing a mental health crisis or emergency, please contact emergency services (911 in the US) or a crisis helpline immediately. Ki is not equipped to handle emergency situations.

6.3 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6.4 AI Limitations

Ki uses artificial intelligence and emotion detection technology that may not always be accurate. AI responses are generated based on patterns and training data and should not be considered infallible or as professional guidance. Users should exercise their own judgment when interpreting AI-generated content.

6.5 Third-Party Services

Our Service integrates with third-party services including Hume AI for emotion detection and voice processing. We are not responsible for the performance, accuracy, or availability of these third-party services.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event will our aggregate liability for all claims relating to the Service exceed the greater of $100 USD or the amount you paid us, if any, in the last 12 months.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, licensors, and service providers, and our and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in San Francisco County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
